1. General Information

These Terms and Conditions (“Terms”) govern the use of the website and services provided by CreAIthing (hereinafter: “Company”, “we”, “us”, or “our”).

They are drafted in accordance with:

  • The Consumer Protection Act (ZVPot)
  • The Electronic Commerce Market Act (ZEPT)
  • The General Data Protection Regulation (GDPR)
  • Applicable EU consumer and digital services regulations

By accessing this website or purchasing services, you confirm that you have read, understood, and agreed to these Terms.

2. Scope of Services

CreAIthing provides digital services including:

  • AI-generated video content
  • AI UGC (user-generated style) content and AI influencers
  • AI-generated images and creatives
  • Advertising creatives and campaign assets
  • AI content systems and automation solutions
  • Website content creation (SEO & conversion-focused)
  • AI consulting and strategy

All services are delivered digitally unless otherwise agreed in writing.

3. Contract Formation

A contract between the Client and the Company is concluded when:

  • An order is placed via the website, email, or agreed platform, and
  • Payment is successfully completed (unless invoiced otherwise)

For custom services, a separate written agreement, offer, or proposal may apply and override parts of these Terms.

4. Prices and Payment Terms

  • All prices are stated in EUR (€) and include VAT where applicable
  • Payment must be made in advance unless otherwise agreed
  • We reserve the right to change prices at any time without prior notice
  • Services will not begin until payment is received

For larger projects:

  • Partial payments or milestone-based billing may be required
  • Late payments may result in delayed delivery or suspension of services

5. Delivery of Services

  • Delivery timelines are estimates and depend on project scope
  • Delays may occur due to:
    • Incomplete client input
    • Delayed feedback
    • Additional revision requests

The Company is not liable for delays caused by the Client.

6. Right of Withdrawal (EU Consumers)

In accordance with EU consumer protection laws:

Consumers normally have a 14-day right of withdrawal for online purchases.

However, by purchasing our services, you expressly agree that:

  • The service may begin immediately, and
  • You lose your right of withdrawal once the service has been fully performed or started with your consent

This applies to all digital and custom content services.

7. Client Responsibilities

The Client agrees to:

  • Provide accurate, complete, and timely information
  • Ensure they have rights to all materials submitted (logos, images, videos, etc.)
  • Respond to requests and feedback within a reasonable timeframe

The Company is not responsible for issues caused by incorrect or incomplete input.

8. Revisions Policy

  • Each service includes a defined number of revisions (specified in the offer/product)
  • Revisions must stay within the original scope
  • Additional revisions or scope changes may be billed separately

9. Intellectual Property Rights

9.1 Transfer of Rights

Upon full payment:

  • The Client receives a non-exclusive, worldwide license to use the content for commercial purposes

9.2 Limitations

The Client may not:

  • Resell, sublicense, or redistribute content as a standalone product without permission
  • Claim exclusive ownership of AI-generated systems or methodologies

9.3 Company Rights

The Company retains the right to:

  • Use delivered content for portfolio, marketing, and promotional purposes
  • Showcase anonymized case studies unless explicitly agreed otherwise

10. AI-Generated Content Disclaimer

Due to the nature of AI-generated content:

  • Outputs may be similar to publicly available or third-party materials
  • The Company does not guarantee originality in a legal sense
  • The Client is responsible for final use, compliance, and verification

We strongly recommend legal review for high-risk use cases (e.g., trademarks, regulated industries).

11. Limitation of Liability

To the maximum extent permitted by law:

The Company shall not be liable for:

  • Indirect or consequential damages
  • Loss of revenue, profit, or business opportunities
  • Platform-specific performance (e.g., ad results, algorithm changes)

Total liability is limited to the amount paid for the service.

12. Confidentiality

  • All client information is treated as confidential
  • We implement appropriate technical and organizational measures to protect data
  • Confidential information will not be shared with third parties without consent

13. Data Protection (GDPR)

We process personal data in accordance with the General Data Protection Regulation (GDPR).

14. Termination of Services

We reserve the right to:

  • Refuse or terminate services in case of:
    • Breach of Terms
    • Non-payment
    • Abusive behavior

In such cases, no refund is guaranteed.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Slovenia.

Any disputes shall be subject to the jurisdiction of the competent courts in Slovenia.

Refund & Returns Policy

16. Nature of Services

All services provided by CreAIthing are:

  • Digital
  • Custom-made
  • Tailored to client specifications

Therefore, standard return policies do not apply.

17. Refund Policy

Refunds are generally not available once:

  • Work has started, or
  • Content has been delivered

18. Exceptions

Refunds may be issued in the following cases:

  • Duplicate payment
  • Service not yet started
  • Inability of the Company to deliver the agreed service

All approved refunds are processed within 5–10 business days.

19. Service Satisfaction

If you are not satisfied:

  • You may request revisions within the agreed scope
  • We will make reasonable efforts to resolve concerns

Customer satisfaction is a priority, but does not guarantee a refund.

20. Subscriptions (if applicable)

  • Subscription services renew automatically unless canceled
  • Cancellation must be made before the next billing cycle
  • No refunds are issued for active billing periods

21. Chargebacks and Disputes

  • Clients agree to contact us before initiating a chargeback
  • Unjustified chargebacks may result in:
    • Service termination
    • Legal action
